1. Acceptance of Terms

By accessing or using SwapAHour ("Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform. These Terms constitute a legally binding agreement between you and SwapAHour.

2. Description of Service

SwapAHour is a peer-to-peer platform that facilitates skill exchanges between users using a time-credit system. The Platform enables users to offer their skills and services in exchange for time credits, which can then be used to receive skills and services from other users. All hours are valued equally regardless of the type of skill or service provided.

SwapAHour is a platform only. We do not provide, perform, or control any of the skills or services exchanged between users. We are not a party to any agreement between users and do not employ, recommend, or endorse any user.

3. User Accounts and Eligibility

To use certain features of the Platform, you must create an account. You must be at least 18 years old to create an account and use the Platform. By creating an account, you represent and warrant that:

• You are at least 18 years of age
• All information you provide is accurate, current, and complete
• You will maintain the accuracy of such information
• You have the legal capacity to enter into these Terms
• You will not use the Platform for any illegal or unauthorized purpose

4. Time Credit System

SwapAHour operates on a time-credit system where one hour of service equals one time credit, regardless of the type of skill or service provided. New users receive 5 starting time credits. Time credits are earned by providing services to other users and spent by receiving services from other users.

Time credits have no monetary value and cannot be exchanged for cash. The equal valuation of all hours is fundamental to our platform's operation as a time bank rather than a commercial barter exchange.

5. Platform Role and Limitations

All skill exchanges are directly between users. You are solely responsible for evaluating the suitability of other users and the services they offer.

To the fullest extent permitted by applicable law, you release SwapAHour, its officers, directors, employees, agents, and affiliates from any and all claims, demands, damages, losses, liabilities, costs, and expenses (including attorneys' fees) arising out of or in connection with:

• Your use of the Platform
• Any skill exchange or interaction with other users
• Any act or omission of any user
• Any content posted by users
• Any dispute between you and another user
• Any personal injury, property damage, or other harm arising from skill exchanges

You agree to indemnify, defend, and hold harmless SwapAHour, its officers, directors, employees, agents, and affiliates from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Any skill or service you provide or receive through the Platform
• Any content you post or submit to the Platform

SwapAHour does not provide insurance of any kind. We do not insure or provide insurance against any losses, injuries, damages, or liabilities sustained by users. You are solely responsible for obtaining appropriate insurance coverage for your activities on the Platform.

We strongly recommend that you:

• Review your existing insurance policies (homeowner's, renter's, medical, umbrella) to understand your coverage
• Contact your insurance provider to confirm coverage for sharing economy activities
• Consider obtaining additional insurance if your existing policies do not provide adequate coverage

11. Tax Responsibilities

SwapAHour operates as a time bank where all hours are valued equally. While time bank exchanges may be treated differently than commercial barter exchanges for tax purposes, you are solely responsible for determining your own tax obligations and for reporting and paying any applicable taxes.

We recommend consulting with a qualified tax professional regarding the tax treatment of your time bank exchanges. SwapAHour does not provide tax advice and makes no representations regarding the tax treatment of time credits or skill exchanges.

12. User Conduct

You agree not to:

• Use the Platform for any illegal purpose or in violation of any laws
• Harass, abuse, or harm another person
• Post false, misleading, or fraudulent content
• Impersonate any person or entity
• Interfere with or disrupt the Platform
• Attempt to gain unauthorized access to the Platform
• Use the Platform to send spam or unsolicited messages
• Offer or provide services that are illegal in your jurisdiction

13. Dispute Resolution

Any dispute arising out of or relating to these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in [Your Jurisdiction], and judgment on the arbitration award may be entered in any court having jurisdiction.

Class Action Waiver: You agree that any arbitration or proceeding shall be limited to the dispute between us individually. 14. Termination

We may terminate or suspend your account and access to the Platform at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Platform will immediately cease. Any time credits in your account at the time of termination will be forfeited.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms.
